The Problem Resolution System
The problem resolution system is used by parents when the school does not follow the law.
Here are some examples of possible school system violations:
If you requested an evaluation and it is not being provided
School is providing you with information about the special education law, that you believe is incorrect
Timelines have not been observed
IEP is not being implemented
The Department of Education (DOE) has a Problem Resolution System set up to quickly resolve disputes over noncompliance with special education law and to see that schools obey the law.
Another Way to Resolve A Complaint
Contact your Regional Associates if you want to file a complaint against the school for being in violation.
You have the right to submit a complaint to the New York State Education Department if you believe that your school district has violated procedures under federal and State laws and regulations. You must make your complaint in writing and send it to the Regional Office in your geographical region.
If appropriate, your complaint will be investigated. You will receive a letter of the findings and resolution within 60 calendar days of when your complaint was received.
Special
education issues that are currently being addressed through an impartial hearing
or appeal to the State Review Officer
cannot be simultaneously submitted as complaints.
